An attorney has filed a class action suit against MS as he is claiming that the mighty giant ripped him off when purchasing Xbox LIVE marketplace points. More specifically, he was charged for purchases he couldn't complete due to a 'balky' download system and this was no accident, or say he says.

<blockquote>A Philadelphia-area attorney has filed a class action suit against Microsoft, claiming the software maker ripped him off after he bought points that were supposed to allow him to make purchases over the online Xbox Live Marketplace.

Samuel Lassoff, of Horsham, PA, said an invoice he received earlier this month from Microsoft included charges for purchases he couldn't complete due to a balky download system—and he claimed it wasn't an accident. </blockquote>

A job description from Insomniac has added support to the idea that they are indeed working on a new PS3 exclusive. Howerver, it is highly expected that the job posting is in relation to Resistance 3 which is definitely on the cards from the team.

Reports via Cnet are indicating that third party developers are complaning about Nintendo's lack of online presence. Essentially, the Wii's online multiplayer options are not up to scratch at a time where it is paramount that they are.

<blockquote>It should come as no surprise to Nintendo that third-party developers are beginning to complain about the company's online presence (or lack thereof). In fact, they're calling the company out. According to UK gaming websites, Mass Effect 2 has been leaked already. But apparently, the image size is a fishy 13GB which has raised a few eyebrows...

<blockquote>Websites are reporting that the download size is 13GB, but this leak has resulted in some paranoia. Last year, Forza Motorsport 3 was conveniently 'leaked' onto torrent sites but was later revealed to be a prank by Microsoft and Turn 10 to brick modded Xbox 360 consoles. Sony has confirmed that they are delighted that the PS3 has passed 3 million sales in the UK. They also forsee a great future for the machine with many exclusives coming up for the system including GoD II and Modnation Racers.

Social networking mega site Facebook is set to roll out a new Games Dashboard. Essentially, this is a function that will allow Facebook fans easy access to play and discover new games.

Microsoft has revealed a fantastic stat - over 17 BILLION hours have been spent by folks on Xbox Live. This equates to around 3 hours online the service per each person on Earth.

In something of a subtle dig at GT 5, Microsoft has claimed that Forza continues to define the racing genre. The respective member of staff added that this is especially true from a first party respective as it's the ONLY one to have shipped.

"Capcom X Microsoft" - what could it mean? That is exaclty what Microsoft Japan is teasing on its own website. However, more news on this teaser is due to come out into the wild on January 26th.

<blockquote>Capcom is working on a new Xbox 360 game that isn’t Lost Planet 2, Super Street Fighter IV or Resident Evil 5.

In an interview, Playstation's director of hardware marketing has given some ray of hope that PS2 games may well become available under PSN in the future. However, he did also remark that digital distro is not the only way to make this all happen.

A small poll on the official Playstation forums is pointing to the possibility that there are potentially some serious issues with firmware v3.15. Over 50 percent of those who took part in the poll revealed that they had bad issues or a complete system failure due to the 3.15 update.

<blockquote>While it's a bit early to call things widespread, some forums are once again starting to heat up with reports of various problems that mostly seem to have occurred after the 3.15 update rolled out last month -- although some folks also seem to have had trouble with the earlier 3.10 update. A US Airways customer is understandably annoyed at the actions of the air giant as they 'broke' his 360 by removing internal parts and left them in a ziploc bag. The reason they removed the parts was to make flying 'safer'.

Third party reports denote that Nintendo is debuting 'budget' versions of its software in Japan as of late February. A UK trade mag has added to this new by revealing that Nintendo do not have plans to offer such a product to the UK market.

<blockquote>From February 25th Japanese consumers will be able to get their hands on a brand new range of budget Wii software, Nintendo of Japan has confirmed.

Kotaku reports that the Minna no Osusume Collection – or the Everyone’s Recommendation Collection – will retail for YEN 2,800 (£19). Each title will be branded up with either bronze, silver, gold or platinum badges that are designed to represent that game’s ‘rating’.</blockquote>

Chris O'Brien of Mercury News has an interesting feature on why the Wii is truly more expensive than it seems. While its initial RRP may seem great, he also notes that it can be very expensive when you buy everything to go with it like rechargeable batteries, extra remotes and games like rock band etc.

<blockquote>Then I began looking for a couple of games to go with it. I knew we'd be paying a bit more for these. But as I looked at some games we wanted, like "Lego Rock Band," I realized that I needed other controllers, like a microphone, drums or guitar. These could run another $100 or more if I got all of them. So I passed and didn't get any games, figuring they could just play the games that came with it for now.

As I examined the box, I realized that I had forgotten that the Wii could also be connected to the Web. The problem here was that our cable modem is in the kitchen (don't ask) and the TV is in the living room. Guess that's a headache I'd have to figure out later....

The internet is fresh with reports that EPSN may well show up on Xbox LIVE (meaning you can ditch a cable box). The NYT first broke the story after news got out that MS and Walt Disney had meetings regarding the subject previously.
