As we all know, Nintendo has been making quite an effort to fight against DS flash carts. However, their complaints against devices such as the R4 have been dismissed by a Spanish Judge who ruled that the respective devices can actually ADD functionality to the DS and it's not all about piracy!

Spanish copyright law includes an anti-circumvention clause, but as Leo Martins alerts us, a judge in Salamanca, Spain has taken a much more nuanced view of it in a case pitting Nintendo against Grupo Movilquick, who produced alternative cartridges for Nintendo DS devices. The judge's ruling (translated from the original) appears to find that the alternative cartridges do, in fact, circumvent Nintendo's DRM and can be used for "pirating" games, but also extend the utility of the devices for perfectly legal purposes. For that reason, the judge dismissed the lawsuit (translation from the original) noting that it doesn't make sense that the law would be intended to say that only Nintendo can expand the functionality of its devices, and the fact that Nintendo doesn't offer similar functionality shouldn't preclude others from doing so. There are areas where Nintendo can still bring a lawsuit, such as for patent and trademark issues, but the judge notes those should be dealt with in a civil court.

In the end, the all are used for piracy.

If the only want to add value, then the all should be making cartridges like the iPlayer, No warez, only homebrew (and the greyzone called emulation )

EDIT: The Judge prolly uses Flashcarts himself (and the rest of his family to)

I should be able to do anything I want with the hardware I own. Is nintendo's fault for not making their DS more secure.

You NEED to remember. The carts are marketed to offer functionality to the ds which it does not have in the box - mp3, pictures, stuff. It does NOT modify the hardware hence does not break any copyrights that nintendo has imposed. That is probably why nintendo has such a bee in the butt over this matter.

I think the judge made a lot of sense as he would need to show they were modifying the deive in a manner to affect patents, copyrights.

However the fact that people manage to use the carts to play downloaded roms is just....an aftereffect.:)

Oh, but indeed it does break copyrights. As of DSi's 1.4 firmware they have to use a legitimate game's boot loader ICON and TEXT. Which is stealing IP (Intellectual Property).
