pretty soon everything you buy will probably have a similar license if manufacturers like the idea.
I hope they put a stop to this kind of licensing before it gets out of hand.
If you don't want me to re-sell your merchandise, that's fine.
But if I want to break, hack, make backups, all for my personal use in my home, who are they to tell me that I can't?
As long as it does not infringe on someone's business and is not a danger to anyone else, I'll be damned if I let someone tell me what to do with what I purchase.

This is gunna cause the companies alot of problems. I personally lend out disks for software I have for other people to try. Usually it ends up in them buying the software as well. If you cannot resell the software (same as lending except you dont get it back when you sell it) then publishers are going to have to rely on people downloading trials or demo's before knowing if they would purchase. Alot of trials and demo's do not have full access to everything so people cannot test the features.
I would not buy anysoftware without being able to try and test all the features first.
Great, but AutoCAD is something different from games. For the typical AutoCAD use, a license seems a suitable way to sell the use of the software. For games, the fysical property (game disc+booklets) seems more suitable.
When this rule is commonly usable, we can fear that everything will be sold on a license base in the future. Productivity software, office software, games, cars, food, you name it...
The only way around is not to buy the license but instead pirate the software. Therefore I think the industry is plain stupid once more; instead of discouraging piracy they're stimulating it!
So lets get this right, games are expensive to buy. Brand new titles can be about £40, with roughly 40 hours gameplay (excluding multiplayer).
Devs have already introduced online functionality that only the 1st buyer can take advantage of by using codes shipped in the packaging.
They now want to charge more for online functionality. Microsoft being a good example here as they only allow developers to issue 1 free download per title.
Now they are taking legal steps to completely STOP all preowned sales. and will the price of game fall as a result of this? We all know the answer to that right?
Now picture this... Imagine a world where games cost about £10-15 ($15-20) like DVD movies, there would be NO preowned market at all.......... anywhere.
There would also be no piracy either because modding consoles these days usually means you have to give something up, usually online gaming/downloads. Who will want to mod their console and lose online functions if games only cost £10-15? You could BUY a new game every weekend...you could buy two at a time, and there will probably be curiosity purchases of games that aren't that great but still got your attention for some reason. Which means that devs who spent the last 2 years ultimately making a complete turkey could see some return.
Ok lets step back into the present day reality and look at what we are being 'offered'. £40 for games that you can't resell if you've played the $hit out of it, or realised you made a mistake buying it in the first place. Online functions that are designed to limit and control the user and yet the gaming industry keeps harking on about how piracy and preowned game sales are killing them.

Game: £20-40

Sony sell a PS3 with rented software... now Software companies are thinking the same thing... looks like Im gonna be saving alot of money in the future, as I am not getting involved in any of Sony's or any companies Software rental systems for buying full price products...

Not yet i think. This article only mention that it is about AutoCAD, and since it happend to AutoCAD, someone speculates that it might happend to used game sales as well. AutoCAD is quite expencive (MSRP is $3,995) while a game usually costs $60. I belive that the price of AutoCAD is the reason why this law was approved, but i am not sure though.
That said, someone might take used game sales to court as well. I have heard that they tried to fight used game sales in Japan many years ago, but this case was lost (used game sales are common in Japan now). If someone takes it to court in USA, i dont know if they will win, but who knows.
Is there any console manufacturer that doesnt sell their consoles with "rented software" though?
When you buy a console, either a PS3, a Xbox 360 or a Wii, what you are buying is the phsyical hardware (the console itself) and a "license" (or what i shall call it) to use the OS and software. I have not seen any console that when you buy it, you then become the legal owner of the OS and software.
When you buy for example a Xbox 360 and a subscription to Xbox Live, you dont buy the rights to do whatever you want with these things. You do not become the owner of Xbox Live because you pay for it. Microsoft has decided what you can use Xbox Live for. And all consoles in this generation have enforced firmware updates if you want to use the online part, so this isnt something that you can decide to do yourself (unless there is a way to hack around this, but originally you must have the latest firmware). Is the PS3 any different regarding this?
It is the same when you buy a game or a movie as well. If you buy a game in the stores, then you pay for a cover, a manual, a physical disc with copy of the game files and a "license" to play the game. You do not buy the license to do whatevery you want with this game, you do not buy the rights to the source code or the ownership to the game title/IP.

if i open a game and dont agree with the user agreement can i get a refund?
depends on where the user agreement was... outside or inside of the packaging...
if on the inside, I presume you would have to go back to the manufacturer for the refund under the grounds that you dont agree with the agreement that you dont get to see until you break the seal... if on the outside you wouldnt have broken the seal and again you could claim refund...
suggest you ask at your local trading standards dept. (if in the UK)
I think you will find a license or user agreement cannot override and laws of the country where item is sold...
