    The US International Trade Commission ruled that Microsoft violated four Motorola Mobility patents with Xbox 360. Also, Apple violates a 3G related one!

    According to a US International Trade Commission judge, Microsoft violated four Motorola Mobility patents with Xbox 360. Now, a commission will review the ruling and determine what action should be taken! Apparently, the body has the ability and authority to out a ban on selling products which infringe on patents.

    ITC Judge David Shaw said yesterday that Microsoft was violating four of five Motorola Mobility patents. The judge’s findings are subject to review by the six-member commission, which has the power to ban imports that infringe U.S. patents. A second judge at the ITC delayed until today issuing his findings in a separate Motorola Mobility case against Apple Inc. (AAPL)

    The ruling gives Motorola Mobility leverage in its patent fights with Microsoft that may force settlement talks to avoid an Xbox import ban. Motorola Mobility filed in retaliation for Microsoft lodging patent-infringement claims against Motorola Mobility phones that run on Google Inc. (GOOG)’s Android operating system, the most popular platform for mobile devices.

    “Microsoft continues to infringe Motorola Mobility’s patent portfolio, and we remain confident in our position,” said Becki Leonard, a spokeswoman for Motorola Mobility, in an e-mailed statement. “This case was filed in response to Microsoft’s litigate-first patent attack strategy, and we look forward to the full commission’s ruling in August.”
    Wow! But this isn't ending here, as Motorola also won a partial U.S. ITC judge ruling in its bid to block imports of Apple Inc. devices including the iPhone and iPad tablet computer!

    Apple violated one of four Motorola Mobility patent rights being contested, ITC Judge Thomas Pender said in a notice posted today. The patent relates to 3G technology. The other three patents weren’t violated, according to the notice. Pender’s findings are subject to review by the six-member commission, which can block imports that infringe U.S. patents.

    The findings, along with a separate determination yesterday in a Motorola Mobility patent case against Microsoft Corp. (MSFT), are part of a global fight in a mobile-device market Yankee Group projects will expand to $360 billion this year. Google Inc. (GOOG) has said its $12.5 billion purchase of Motorola Mobility and its trove of patents may protect it against litigation by rivals to its Android operating system.

    “These are long wars, and it’s one more battle in the war,” said Carl Howe, an analyst with Yankee Group. “It’s about accumulating as much intellectual property as possible. It’s not good for innovation if you do that, but that seems to be where we’re heading.”
    How these will end? If they reach a "settlement", the decision could be tossed. Yep, that is the most likely scenario, but anything could happen!

    So what patent infringements are MS calling out on motorola in response to this then, if they havn't already. You know it's going to happen it always does, tho it's funny that Motorola always seem to be involved in these things, either they have a lot of clever people there or they like to change the way their patents are used and the like and are not very flexible, I'm suspecting a bit of both.

    Consoles - Wii, Xbox 360 Elite, Xbox 360 Jtag Jasper 2TB 3.5" HDD, PS3 60GB UK launch version, PS3 hacked with 500GB 3.5" HDD (2TB wouldn't work ).

    PC - i7 3930K @4.6GHZ, Asus Rampage IV Extreme, 2xRadeon 7970, 32GB DDR3, 4TB Raid HDD (4X Samsung Spinpoint F3, SSD boot drive OCZ Vertex 3 120GB )

    These are gaming systems I am biased towards (may as well throw in everything from last gen and before as if the PC can emulate it I am likley to have it)

    ... I remember the days when google's motto was "Do no evil"... *SIGH* seems so long ago. I'd still take an android phone over windows or ios though.

    Now lets be fair, if you put a stale dog turd on your garden it would act as a fertaliser, chuck an iOS device on there and at best it will just stop anything growing under it, tho it more likely just littering the garden.
