    Exclamation Apple wins EU Ban of smaller Samsung tablet, demands $2.5 Billion in damages

    But loses the 10.1N appeal.



    Seems that Apple won an European ban on Samsung Galaxy Tab 7.7, outlines proposed damages of $2.5 billion or more.

    Apple has won a preliminary injunction against the Samsung Galaxy Tab 7.7 across the European Union, thanks to a decision in a German regional court today.

    However, the court re-affirmed the denial of an injunction against the Galaxy Tab 10.1N, a version of Samsung's 10.1.

    Apple had been seeking an injunction against the Galaxy Tab 10.1N, but was rebuffed back in February by the Dusseldorf Regional Court, which claimed the redesign was distinct enough from the original Galaxy Tab 10.1 that the original injunction ought not to apply. Now that the decision has been upheld, Apple could be out of appeal options. It's important to keep in mind that this is all based on preliminary injunction requests, and the full trial on the merits is still to be held. Samsung sent us a statement in response to the 10.1N decision, saying:

    "Samsung welcomes the court’s ruling which confirms our position that the GALAXY Tab 10.1N does not infringe Apple’s intellectual property and does not infringe laws against unfair competition. Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted."

    The Galaxy Tab 7.7 injunction was a different story, however, as Apple won a preliminary ban across the EU. Previously, the smaller tablet had only been banned in Germany, but this most recent ruling apparently prevents Samsung's parent company from selling it anywhere in the EU. Samsung's statement regarding that decision was predictably a little more negative:

    "Samsung is disappointed with the court’s ruling. We will continue to take all available measures, including legal action, to protect our intellectual property rights and defend against Apple’s claims to ensure our products remain available to consumers throughout the European Union."
    Now, the two companies are still fighting in the US as well. In a filing today in a San Diego, California court, Apple is claiming $2.5 billion in damages.

    "Samsung's infringing sales have enabled Samsung to overtake Apple as the largest manufacturer of smartphones in the world. Samsung has reaped billions of dollars in profits and caused Apple to lose hundreds of millions of dollars through its violation of Apple's intellectual property."
    Apple argues that the company "chose to compete by copying Apple." Samsung, thinks it should owe much less —$0.0049 per unit per patent— if anything.

    So, the patent wars continue. And seems that Apple is taking the lead...

    Another great way to see how fucking crap Apple/Sheep Inc. is these days, or been for a long time actually.

    Sony isn't exactly famous for being consumer friendly, but they are still not as **** as Sheep Inc.

    Sony is more like "Buy our products, then get the **** outta here" attitude.
    Apple also shares Sony's idea on how to treat consumers like ****, but they are also greedier than EA which combined makes them maybe the worst company on the planet.
    How could EA get this low rating when Apple is worse?
    Why is so many people defending EA, when they are a shit company with yearly shovelware? They even won a prize for it twice.

    Where were you when we were protesting against software patents? If you weren't one of the protestors, STFU. If you were, blame the game, not the players, and keep protesting!

    Blame the US government, they forced it through everywhere else is very iffy about granting software patents, which is why they will be filled for in the US then have a priority claimed on them in other countries based on the US Patent Office granting them the patents with little issue. Also blame the whole co-operation between Intellectual Property Offices for their way of treating patents from other countries when it comes to granting them in their countries, and in this case the likes of EPO and WIPO for worl wide or continent wide patents based on US patents etc.. It's a lot more complicated than you think when it comes to Patents and complaining in one country doesn't mean it won't get the go ahead in another and so be able to claim priority from that country and so have a basis for a legit claim in another (if another patantee hasn't applied for a one before their original one).

    By the way it was the likes of apple that managed to force the Software patents through, so yeah they are heavily open to blame, and also it would appear that given the sales ratio's and the dropping Apple market shares in tablets and phones, many do agree and only sheep on forums and idiots seem to think otherwise. I think I would be safe in saying most people don't hate Apple for being Apple they just hate them for the clueless fans who like them because some idiots told them it's cool to. Mind you I dislike the likes of iOS as it's gimped on purpose and I hate OS X for many more reasons though especialy the Fisher Price level of the OS with the god aweful laggy mouse by default that you can't fix (yeah that mouse lag is an OS issue and it frustrates me that much that I actually would rather use a touchpad so as to not cramp my hand up, as at least they hide the lag a bit).

    Its good to hear that their sales is going down too, but their greed will make them pursue as many companies as they can to get income in different ways as long as they can.

    It will backfire to them later in a negative way. History shows that alot of ruthless and egoistic big companies never last. We also know that fashion wear off, especially from companies that barely isnt able to renew their design. Everything they make looks like black and white toys i think.

    Oh god yeah, I remember that one button mouse, tho I was forced to use for the likes of QuarkXpress or however you spell it when I used to work at the local newspaper, mind you back then you could see how much of a completely blatant rip off of the amiga workbench it was, mind you that is probably the last thing apple admited to ripping off tho OSUX is little more than a tarted up version of that. I am beginning to think that mice and macs do not make a good combo, they are either intentionally gimped button wise (and still are to a large degree, no default support for back and forward buttons that are a pretty standard feature on practically any other desktop OS, tho my MS mouse drivers do at least bring back the functionality, kind of ironic really) or apparently for years they ahve suffered from mouse lag, tho because Mac only users don't know any better they claim there is no problem, tho it reminds me of the Wii controller and that noticable lag when you move the controller compared to the pointer on the screen so that it feels like you are dragging it along instead of matching your hand movements. It says somthing that when I am forced to use a Mac or a Hackintosh (tho mainly for my Asphalt 6 on the big screen fix ), I try to use either the keyboard or if possible a joypad cia controllermate or a touchpad, just because that lag make prolonged use uncomfotable for me. I guess Mac users are used to mentally reacting slower on average :P

    I'm starting to move away from Apple myself (at least portable wise, hackintoshed OSX).

    Last contract I got an iPhone because of the App store and jailbreaking (upgraded from an ipod touch 2g), this time I got a GSIII because the openness of the platform far better suits my needs.

    Apple screwed themselves from my custom because of their closed ecosystem.

    Maxconsole comment suddenly isnt compatible with my older Opera browser anymore, so i had to get a different browser just for MC.

    Amiga 1000 and 500 was just awesome back then. If you skipped gaming, and went all the way out on the OS it was like a new computer world. It looked simple, but was damn powerful. Of course Apple had to rip off this, but it wasnt as good. People wanted Amiga, and not MAC looking at sales, scene etc.
    MAC was probably made for Keyboard like Windows 3.1 was..haha. Win 3.1 was so crap with mouse that, keyboard was preffered by and many others.
    MAC is probably made for slow people as you say..hehe. People must be slow when they swear (sheeping) to a inferior system, when there is better things on the market at a lower price.

    Windows 7 is a very good OS, but it still doesent have the powerful features which Amiga had 20 years ago. Intuition, pre-emptive multitasking, and dynamic RAM among other things. These awesome features died with Amiga, but it still lives today as Amiga OS is still updated by someone, or use a custom OS overlay which is updated frequently. The way a PC is designed, its hard/imposslble to even implement some of the Amiga features. Amiga had everything on-board as standard, while a PC didnt.. PC can have complete Mobo's today with no external cards, but its still the same old architecture minimized on a mobo instead of slots.

    That is strange, we din't change anything major on the site, I was working on a new skin, but have not made it the default, so I switch back to the old one.

    Got any screenshots? -- What version of Opera? -- I also heard someone with FF had problems with 'quick reply', are you using that or normal reply?

    Only thing I noticed is stuff like ", - , ' , $ symbols will sometimes for some weird reason have extra letters added in front of it, but if you re-edit the post they disappear.

    I use Opera 10.10 which is probably years old now. The reason is that they changed Opera to the way i liked it less, so i'm stuck with 10.10.

    Any "reply" doesent work anymore. I can write in title box if i want, but the comment box shows when page loads for like 0.5 second and then its totally gone. Just plain white.
    A comment box with no border, and it isnt there since in this browser now. I click everywhere and there is no way to get a cursor there. Comment title box shows and works thou.

    Layout is correct on whole page thou.
