Exclamation Konami offers free game exchanges to Silent Hill HD Xbox 360 buyers

For those Americans mad at the buggy HD Collection.

The Silent Hill HD patch won't arrive to Xbox 360, so that's why Konami decided to offer a free game exchange by way of recompense.
    Currently only available in America.

As you may know, the Xbox 360 version of Silent Hill HD Collection won't be patched, so that's why Konami has begun an exchange program for all the angry American buyers out there.

This offer only applies to copies bought before August 8 from "recognized retailers", and allows customers to return their copy of the game in exchange for a select title.

The transaction must be insitgated before October 7 for the offer to remain valid and you need you receipt, of course.

Here's the official post at the Konami's Silent Hill Facebook page:

    Attention Silent Hill fans:

If you purchased Silent Hill HD Collection for the Xbox 360 new and from a recognized retailer, and still have the original receipt, please send your receipt to Konami Customer Service for verification and further details on how to exchange your product. This offer is only valid for Silent Hill HD Collection (XBOX 360 version) games purchased on or before 08.08.2012. All requests must be made in writing and submitted on or before 10.07.2012 and is subject to availability. Any inquiries received after this date will not fall under this exchange program. This offer valid for purchases made in North and South America.

Note: The patch for Silent Hill: Downpour for both Xbox 360 and PlayStation 3 is still currently in development and scheduled for release at a later date.

Seems like a half arse gesture to cover their own backs, an exchange won't cost them anything in real terms, tho a full refund would and it's the full refund that should be the primary option with an exchange just being an additional option. If they were made to give a refund instead I bet you can guarantee that the patch would hit XBL in next to no time.
    My gaming systems -
    Consoles - Wii, Xbox 360 Elite, Xbox 360 Jtag Jasper 2TB 3.5" HDD, PS3 60GB UK launch version, PS3 hacked with 500GB 3.5" HDD (2TB wouldn't work ).

    PC - i7 3930K @4.6GHZ, Asus Rampage IV Extreme, 2xRadeon 7970, 32GB DDR3, 4TB Raid HDD (4X Samsung Spinpoint F3, SSD boot drive OCZ Vertex 3 120GB )

These are gaming systems I am biased towards (may as well throw in everything from last gen and before as if the PC can emulate it I am likley to have it)

?? someone will trade in silent hill hd for the ps3 for a 360 version?? why?? the ps3 version got the patch so it would seem pointless.

good point, ignore me, i was being dumb, actually thats a good idea, i was thinking it was both versions being traded in as faulty forgetting they fixed the ps3 version.

Yes and No, IIRC MS employ a limit on the size of the patches, the only workaround I can think of is either they beg to MS or they make a patch which allows them to release the real fix via the marketplace (again subject to MS's policy).

I wonder if the only real reason they're doing this is a fear of being sued, wouldn't surprise me if their next game includes an EULA banning class action lawsuits.

Still, I wonder if UK customers could still get something though one of our laws?

indeed you can, use the same law that entitled every new ps3 phat buyer to a refund / compensation when they illegally removed the other os feature, you must claim against the store you purchased the NEW game from with your receipt under the sale of goods act (as amended), if the store wont help contact trading standards.
