According to a company which specializes in IP law and consumer class actions, an investigation is currently underway over the banned Xbox 360's. The company is urging any people who were banned from Xbox Live but not refunded over their remaining contract to come forward and participate in a class action against MS.

Could this mean that the PS3 is finally on the path to dominating success? Newly announced figures state that sales of the PS3 in North America are UP 70 percent during October. One analyst noted that the whole console race is marathon, and in that case, Sony has every chance of a strong race.

<blockquote>In news that may well mark the moment that PS3 finally turned the corner, Sony has announced that North American sales of the console for October are up 70 per cent compared to the same month in 2008.

Also significantly up year-on-year are downloads from PSN, with October seeing more revenue generated from the download portal than any other month to date. In total 650m pieces of content have been downloaded to date, with the number of registered users passing 31m.

Polyphony Digital has revealed that wit Gran Turismo 5, they are edging closer to reality with the reallism of the game. Apparently the cars are easy to drive but as soon as you lose control you will really feel it much more realistically.

Kazunori Yamauchi has indeed confirmed that the Gran Turismo 5 weather system has been completed, but questions remain as to whether it will actually make its way into the final game. The question revolves around whether the weather actually improves the driving experience.

According to unconfirmed rumors, Sony is in talks with Mozilla over the possibility of porting FireFox over to the PS3. While this sounds promising, obviously there will be a whole lot of security issues to investigate if this browser ever found its way onto the PS3.

Alex Verrey of MadCatz has told the gaming media that Microsoft can't and wouldn't lock out their third party wireless network adapter. Very noted that MS is a licensee of theirs and MadCatz would never do anything to battle against them. Hopefully MS will see it that way as well.

Uncharted 2 is leading the way in this year's video game awards with EIGHT award nominations. Elsewhere, MW2 has got six nominations and Left 4 Dead 2 has about the same amount.

<blockquote>"Uncharted 2: Among Thieves" has seized a leading eight nominations for this year's Video Game Awards, Spike TV announced Wednesday.

The action-adventure "Uncharted 2" is bucking for Game of the Year, as is "Batman: Arkham Asylum," which logged a total of seven nominations, according to Spike TV, which presents the awards.

The CEO of BioWare has revealed that the motion sensing technology that is available in the upcoming Project Natal is something which could certainly 'work' for upcoming Natal games. He added that the best games will use Natal as a core part of their game instead of as an add-on.

<blockquote>BioWare CEO Dr. Ray Muzyka has stated that the motion sensing tech found in Microsoft's upcoming Natal "certainly could" work with future BioWare games, saying that the best games will likely "approach Natal as a core part of the game as opposed to an add-on or an afterthought."

News has come forward that hackers have found a way to stop the 'HD crippling' that comes with the recent bans imposed by MS on 360's. The NAND focused adaptation looks to be for tech-savvy folks and will not block the ban itself.

The boss of Buzz! has launched an attack on the 360, claiming not only is it ugly but also noisy. However, the boss has clear love for the PS3 calling it a bargain and pretty. Apparently, the PS3 is the only machine his wife allows in the living room and his Xbox broke.

Eedar's Jesse Divinch has cited marketing as the reason for the poor sales of the PS3. He noted that it's not the high price point, rather Sony's lack of marketing skills and poor judgement in adverts which proved to be a crucial stumbling block in the progress of the system.

<blockquote>According research firm EEDAR's Jesse Divnich the poor sales of the PS3 back at its launch should not be attributed to its high price point, but the bad marketing support for the console.

CNET has revealed the results of their very own survey into console breakages. And the 360 leads the way with a 60 percent defect rate, followed by the PS3's 16 percent and 6 percent for the Wii.

<blockquote>CNET UK commissioned the survey last month -- and the results don't reflect well on the Microsoft console. Some 1,128 UK-based console owners responded, of whom 562 owned Xbox 360s, 473 owned PS3s and 591 had Wiis (some owned more than one).

Reggie Fils-Aime has revealed that the next version of the Wii will not be just HD enabled, rather it will have additional capability. He added that there will be additional elements but they will be 'far into the future'.

AC has provided a new analysis on why the banning of 360's is a bad move from MS. The argument revolves around the idea that banning systems was foolish considering we are entering the holiday season now. The bans are causing confusion, for example at GameStop a mother bought a PS3 for her son instead of an Xbox 360 because she thought he could get banned for downloading content.
